Knowledge. Where any representation or warranty contained in this Agreement is expressly qualified by reference to the knowledge of TransAlta, it refers to the actual knowledge (having made due inquiry) of John Kousinioris, Kerry O'Reilly and Todd Stack, in each case in their capacities as officers of TransAlta and not in their personal capacities and without personal liability, and does not include the knowledge or awareness of any other individual or any constructive, implied or imputed knowledge.
